Answer Writing Query

Exams

answered on 18-Jan-21 11:28

In exams, instead of writing words like, 'Less than and upto', 'Equal to and more than' etc., can we use mathematical symbols instead in papers like company law, taxation etc. where there are conditions etc. in a section. Will it have any negative effect on checkers mindset since it is subjective or ICAI allows such things as standard?

latest answer

yes.

Corporate & Other Laws

answered on 11-Jan-21 14:31

The act done beyond MoA is void. Does the law penalise a company for violating its MoA. eg: If IndigoLearn starts stock brokerage business (not mentioned in object clause) along with selling courses, that businesss will not be valid. Will the Law penalise IndigoLearn Pvt Ltd?

latest answer

For default in complying with the requirements of section 4 (Memorandum), i think the penalty will be as per section 450 (Punishment where no specific penalty or punishment is provided). Company and every officer of the company who is in default or such other person shall be punishable with fine which may extend to Rs. 10,000 and where the contravention is continuing one with a further fine which may extend to Rs. 1000 for every day after the first during which the contravention continues.

General Reserve

Accountancy

answered on 11-Jan-21 08:54

Sir, in the video for reserves and surplus, you mentioned that if a company wants to move back amount from general reserves to P&L for payment of dividend, there are certain restrictions. But why will a company move back the amount from reserve to P&L? it can distribute dividend directly from profit after transferring to reserves.

latest answer

To declare dividends from General Reserve, there are conditions prescribed in Companies Act.

Sir, in the video for share capital, you said that nowadays there is limited applicability of share warrants. Does that mean that only some companies are permitted to issue them or does it mean that only few companies issue them (by choice)?
