The key point here is to identify if a contract is dependent on some collateral event i.e. an event which is - NOT a performance promised - AND NOT a whole consideration for promise Example 2: Here securing loan is a collateral event. Performance which B has to do is to sell house to A, A's performance will be to pay â?¹5L A promises to pay B â?¹1,00,000 if he marries C: Here B marrying C is a performance which B has to do to get â?¹1L. So, there is no collateral event here.
