In conversion of capital asset into stock in trade concept Converting expenses is given can we deduct from sale consideration???

latest answer

When capital asset is converted into stock in trade, it is called as transfer. FMV of the asset must be taken as sale consideration which takes into consideration all the expenses. Need not to be taken separately. It will be taxed in the year in which the stock in trade will be sold.

ITC

Indirect Taxation

answered on 26-Apr-21 12:12

If a businessman constructs building for his business showroom and incurs expenditure on cement, materials etc. and pays GST on such material, Is he allowed ITC for that ? And can he adjust such ITC against output tax ?

latest answer

ITC shall not be available in respect of the goods/services/both received by a taxable person for construction of an immovable property (other than plant or machinery) on his own account including when such goods or services or both are used in the course or furtherance of business. Example - if a building developer engages services of a sub-contractor for certain portion of the whole work. The sub-contractor will charge GST in the tax invoice raised on the main contractor. The main contractor will be entitled to take ITC on the tax invoice raised by sub-contractor as his output is works contract service.

Why in this question power is apportioned on the basis of H.PÃ?MACHINE HOUR . If it is apportioned only on the basis of horse power is it is wrong

latest answer

Horse power is the power an engine produces per machine hour. So we multiply it with the number of machine hours and power is apportioned based on the resultant.
