What is a continuing failure? Does it mean that the company is not filing the declaration with RoC for a continuing period or does it mean that the company is not paying the basic penalty for a continuing period.?

As per Sec.40(2) and Sec.40(2b), in the class - says income tax paid is not taken as an expense? Income tax is paid by the company can be taken as the expense? That's an expense for the company? Sec.40(2b) says - Amount paid to Govt. undertakings is not taken as an expense? For eg., if a property tax/building tax paid by the company to the municipality is taken as an expense for the company? In a normal manner, the above two examples are purely business-related. Then why disallowed?
