Cost of improvement
Direct Taxation
answered on 12-Jun-21 16:14
Sir in capital gains, if an asset is purchased before 1-4-2001we have to take the cost of acquisition, either on the date of the purchase of the asset or fmv as on the 1-4-2001 at the option of the assesse. But in case of cost of improvement you said that we should not take the cost of improvement made before 1-4-2001 because of the fair market value of the asset as on the date of 1-4-2001 includes the cost of improvement made before. But for e.g., if an assessee acquires an asset as on 1/4/1999 costs 1000000. And fmv as on 1/4/2001 800000. In that case if an assessee takes the cost of acquisition as on the date of the purchase (i.e., on 1/4/1999) as it is beneficial to him. In that case as we didnt took the fmv on 1/4/2001 the cost of improvement will not include. So, can we consider the cost of improvement before 1/4/2001 also?
