Apportionment of ITC - sec 17(2)
Indirect Taxation
answered on 19-Jun-22 22:47
We need to apportion the ITC for taxable and exempt supplies, when goods or services are used for both. Why do we need to find the value of exempt supplies? As per 17(3), sale of land, building, transaction in securities etc are exempt supplies, why do we need to find the value of exempt supplies? Can anyone give me full length example using above exempt supplies? What does value of exempt supplies implies?

RIGHT OF STOPPAGE IN TRANSIT - Unpaid seller.
Corporate & Other Laws
answered on 16-Jun-22 09:47
Does Constructive delivery capable to terminate right of stoppage in transit entitled by an unpaid seller?
latest answer
The right of stoppage in transit means that an unpaid seller has the right to stop the goods while they are in transit, regain possession, and retain them till he receives the full price. When the transfer of goods is done without any change in possession, then it is a constructive delivery. It could mean that the seller, even after selling the goods, holds them as bailee for the buyer. So in case of constructive delivery, goods are still with seller, so there wont be any transit

What would be the answer
latest answer
At times there are different assumptions taken by ICAI in their suggested answers. The answer here shall be based on Section 25(1) where the agreement made out of natural love and affection is valid without consideration. Mrs. Lali can file a suit to recover the promised amount. You just have to write the provisions clearly and give your conclusion.
