Taxability of land/building or both in the hands of the transferor and the transferee
Direct Taxation
answered on 27-Jul-22 07:34
As per sec 56(2)(x), when a transfer of immovable property is effected without a consideration and where the stamp duty value( SDV) of such property exceeds Rs.50,000, the SDV will be taxed as the income of the transferee. Will there be a tax impact in the hands of the transferor also u/s 50C when there is no consideration? If yes, pls comment on the double taxation assuming that the SDV of the immovable property exceeds Rs. 50,000.
